{"id":9869,"date":"2021-11-12T15:31:51","date_gmt":"2021-11-12T04:31:51","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/?post_type=institutions&#038;p=9869"},"modified":"2026-04-16T10:49:39","modified_gmt":"2026-04-16T00:49:39","slug":"nsw-juvenile-justice-facilities","status":"publish","type":"institutions","link":"https:\/\/kelsolawyers.com\/au\/institutions\/nsw-juvenile-justice-facilities\/","title":{"rendered":"Offending Institution: NSW Juvenile Justice Facilities"},"content":{"rendered":"<h3>Were you abused at any of these facilities? <span style=\"text-decoration: underline;\"><a href=\"https:\/\/kelsolawyers.com\/au\/application-for-compensation\"><span style=\"color: ffcc01;\">Click here to share your story with us.<\/span><\/a><\/span> You may be eligible for compensation.<\/h3>\n<p><span style=\"font-weight: 400;\">Mt Penang (now \u201cFrank Baxter\u201d), Reiby, Cobham, Minda, Minali, Keelong, Riverina and a slew of other locations were holding facilities for remanded and sentenced juvenile detainees in New South Wales.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These facilities became notorious for their harsh conditions and the outright abuse doled out by both male and female staff members. Problematic teens were often manhandled and provoked on purpose, so the staff could abuse and punish the children further.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Little was done to rehabilitate the teens. Nothing was done to help them heal from past trauma \u2014 but that\u2019s just how \u201cjuvenile justice\u201d worked until recent years.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The NSW juvenile justice system has a lot to answer for.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this article, we expose some of the worst offenders in NSW and share the experiences of detainees who were let down, abused and abandoned by the institution assigned to rehabilitate them.\u00a0<\/span><\/p>\n<h2><strong>Mt Penang Training School<\/strong><\/h2>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-9873 size-full aligncenter\" src=\"https:\/\/kelsolawyers.com\/au\/wp-content\/uploads\/2021\/11\/hennie-stander-p4jsgUB3F28-unsplash.jpg\" alt=\"boys digging\" width=\"1920\" height=\"1143\" srcset=\"https:\/\/kelsolawyers.com\/au\/wp-content\/uploads\/2021\/11\/hennie-stander-p4jsgUB3F28-unsplash.jpg 1920w, https:\/\/kelsolawyers.com\/au\/wp-content\/uploads\/2021\/11\/hennie-stander-p4jsgUB3F28-unsplash-300x179.jpg 300w, https:\/\/kelsolawyers.com\/au\/wp-content\/uploads\/2021\/11\/hennie-stander-p4jsgUB3F28-unsplash-1024x610.jpg 1024w, https:\/\/kelsolawyers.com\/au\/wp-content\/uploads\/2021\/11\/hennie-stander-p4jsgUB3F28-unsplash-768x457.jpg 768w, https:\/\/kelsolawyers.com\/au\/wp-content\/uploads\/2021\/11\/hennie-stander-p4jsgUB3F28-unsplash-1536x914.jpg 1536w\" sizes=\"(max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<p style=\"text-align: center;\"><span style=\"font-weight: 400;\">Image: <\/span><a href=\"https:\/\/unsplash.com\/photos\/p4jsgUB3F28\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">Unsplash<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">Close to Gosford on the Central Coast of New South Wales, boys were sent to Mt Penang after being convicted or had been declared \u201cdifficult to manage\u201d in other institutions run by the Child Welfare Department.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some of the boys were <\/span><a href=\"https:\/\/www.lawyersweekly.com.au\/biglaw\/28653-the-boys-were-their-toys\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">sent to Mt Penang for merely missing school<\/span><\/a><span style=\"font-weight: 400;\">. Others were sent to Mt Penang because their mothers could no longer care for them or couldn\u2019t cope with their own personal battles.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The boys were aged 14 to 16 and were subjected to harsh discipline \u2014 according to the Child Welfare Department:\u00a0<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">\u201cAn inmate of Mt. Penang is exposed to a regulated, demanding program from 6 a.m. until 9 p.m. In the course of each day, therefore, he is brought into contact with varying influences, depending on his location, which has a decided impact on his attitude, behaviour, and character.\u201d<\/span><\/i><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Those who did not submit to this regime were sent to even worse institutions like <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/daruk-boys-home\/\"><span style=\"font-weight: 400;\">Daruk<\/span><\/a><span style=\"font-weight: 400;\"> or <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/institution-for-boys-tamworth\/\"><span style=\"font-weight: 400;\">Tamworth Institution for Boys<\/span><\/a><span style=\"font-weight: 400;\">. Between Mt Penang, Daruk and Tamworth, very few boys were reformed, and many went on to commit violent crimes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mt Penang Juvenile Justice Centre is one of many institutions that failed to care for its inmates and instead chose to abuse them.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2014, a survivor known only as FE submitted an impact statement to the Royal Commission into Institutional Responses to Child Sexual Abuse regarding his time in state care. He spent time in <a href=\"https:\/\/kelsolawyers.com\/au\/our-work\/clergy-and-institutional-abuse-claims\/abuse-law-involving-institutions\/new-south-wales-nine-worst-childrens-homes\/\">Gill Memorial Boys Home in Goulburn (Salvos)<\/a>, the Minda Shelter in Lidcombe, Yasmar Boys Home and Charlton Boys Home in Ashfield, Royalston Boys Home in Glebe and eventually, FE ended up in Mt Penang.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">FE was <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/STAT.0204.001.0001_M_R.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">abused in almost all of the state-run facilities<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It was 1977 when FE arrived at Mt Penang. He told the Royal Commission that Mt Penang was <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/STAT.0204.001.0001_M_R.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">\u201cmore like a jail than a home\u201d<\/span><\/a><span style=\"font-weight: 400;\"> and the boys who lived there referred to the facility as<\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/STAT.0204.001.0001_M_R.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\"> \u201cthe Pound\u201d<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">FE was physically and sexually abused by the officers at Mt Penang on a daily basis. The officers would <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/STAT.0204.001.0001_M_R.pdf\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">strip off his clothes, hose him down and flog him with whatever was available<\/span><\/a><span style=\"font-weight: 400;\"> \u2014 even a garden hose.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This would often lead to anal rape. FE said he would scream loud enough to deter the officers from attacking him, but this often didn\u2019t work.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After three months, FE was sent home to live with his mother.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2016, the Nepean Police Area Command established Strike Force Eckersley in response to complaints from the Royal Commission. An <\/span><a href=\"https:\/\/www.newcastleherald.com.au\/story\/6727954\/central-coast-man-to-face-court-over-alleged-historical-sex-offences\/\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">81-year-old man was issued a Court Attendance Notice<\/span><\/a><span style=\"font-weight: 400;\"> (CAN) for four counts of buggery, three counts of indecent assault on a male and six counts of sexual assault, knowing no consent was given.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is alleged the offender abused six boys between 1977 and 1988. Several cottages were set up in response to overcrowding at the Bidura and Royleston shelters in Glebe, Sydney.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The cottages were designed so children from the same family could live together at a \u201cvery critical period in their lives\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While Minali was built with good intentions, it is alleged that sexual abuse was rampant. In 1996, <\/span><a href=\"https:\/\/www.parliament.nsw.gov.au\/Hansard\/Pages\/HansardResult.aspx#\/docid\/HANSARD-1820781676-9309\/HANSARD-1820781676-9308\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">six children escaped the centre<\/span><\/a><span style=\"font-weight: 400;\"> and made it as far as the Central Coast before they were caught.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the girls claimed<\/span><a href=\"https:\/\/www.parliament.nsw.gov.au\/Hansard\/Pages\/HansardResult.aspx#\/docid\/HANSARD-1820781676-9309\/HANSARD-1820781676-9308\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\"> she had been sexually assaulted at the centre<\/span><\/a><span style=\"font-weight: 400;\">. She was just eight years old at the time.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Three of the children were returned to Minali despite the serious allegations. One of the children was sent home to his parents, and the remaining two were sent to McCredie Cottage, a separate centre from Minali in Lidcombe.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An investigation was launched and the Minister for Community Services, Ron Dyer, ensured the media would not be involved.\u00a0<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">\u201cBased on expert advice from a psychiatrist that broadcast would exacerbate harm to the children, the Department of Community Services has taken Supreme Court action to prevent the broadcast of any material relating to the children, in the interests of the children.\u201d<\/span><\/i><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Dyer then made the decision to close Minali in 1998. This appeared to be in response to the allegations.<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">\u201cI took a decision for good and well-understood reasons to close both the Ormond and Minali institutions.\u201d<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201cWorldwide developments in substitute care support the move away from institutional settings for young people who, I would remind the House, have done nothing wrong \u2014 they have not offended against the criminal law \u2014 but are in need of State care.\u201d<\/span><\/i><\/p><\/blockquote>\n<h2><strong>Reiby Youth Justice Centre\u00a0<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">This is not the first time we have exposed the abuse that occurred within the walls of the<\/span><a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/reiby-youth-justice-centre\/\"><span style=\"font-weight: 400;\"> Reiby Youth Justice Centre<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Following the Royal Commission into Institutional Child Abuse, the Campbelltown Local Area Command formed Strikeforce Redcliffe to investigate allegations of sexual abuse at Reiby. In 2017, two former guards were arrested and taken to Campbelltown Police Station where they were charged with 75 offences.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is alleged that the women physically and sexually abused numerous inmates between 1997 and 2004.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A third woman was jailed in 2020 for engaging in a sexual relationship with a 15-year-old inmate. She had only been working at Reiby for a month before she started slipping the teenager cigarettes and love letters, signing off as Juliet and calling the teen her \u201cRomeo\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She maintained the relationship throughout the teen\u2019s stay at Reiby and moved in with him after he left the facility. There are claims that she became pregnant, but she could not confirm if it was the boy\u2019s child.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The abuse didn\u2019t stop there.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The inmates at Reiby were also subjected to rough strip searches that often turned into sexual abuse. In 2009, an Aboriginal teenager was sent to Reiby, where he was <\/span><a href=\"https:\/\/www.abc.net.au\/news\/2021-05-25\/aboriginal-men-claim-sexual-abuse-youth-detention-strip-search\/100143968\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">stripped naked and searched for contraband<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">&#8220;I was fully naked, and then he said, &#8216;What have you got there? You got contraband?&#8217; And then he grabbed me and because I sort of resisted, he grabbed me a little bit tighter and spun me around viciously and it began from there,\u201d he said.<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">&#8220;It&#8217;s like 12 to 15 times [the abuse] occurred. He assaulted me brutally.\u201d<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">&#8220;[He] said if I told, he&#8217;d f***ing kill me. I would never see my mum and dad. That&#8217;s all I wanted to see was my mum and my dad and my brothers and my sisters.\u201d<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">&#8220;I was scared to tell. I just thought, &#8216;f***, what can I do? I can&#8217;t do anything. So I just had to go with it all the time.&#8221;<\/span><\/i><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">He said the abuse included <\/span><a href=\"https:\/\/www.abc.net.au\/news\/2021-05-25\/aboriginal-men-claim-sexual-abuse-youth-detention-strip-search\/100143968\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">forced oral and anal sex<\/span><\/a><span style=\"font-weight: 400;\">. One of the workers would force him down onto his knees and make him do things he didn\u2019t want to do.<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">\u201cAfter that, it was like he was trying to make love to me.&#8221;<\/span><\/i><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Since his stay at Reiby, the victim has <\/span><a href=\"https:\/\/www.abc.net.au\/news\/2021-05-25\/aboriginal-men-claim-sexual-abuse-youth-detention-strip-search\/100143968\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">self-medicated with drugs and alcohol<\/span><\/a><span style=\"font-weight: 400;\">. He has also attempted suicide on two occasions.\u00a0<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">&#8220;I tried to kill myself twice and still can&#8217;t forget. I just wish I could. I can&#8217;t even act normal around my family. I&#8217;ll go home and it just feels like a part of me is still gone.&#8221;<\/span><\/i><\/p><\/blockquote>\n<h2><strong>Child abuse in Juvenile Justice Centres is an ongoing crisis throughout Australia\u00a0<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Despite various enquiries like the Royal Commission into the Protection and Detention of Children in the Northern Territory, child abuse in youth detention centres continues to be a problem throughout Australia.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As recently as October 2021, Ashley Youth Detention Centre in Tasmania was ordered to close. Concerns about the safety of children at the centre were ignored for decades, and <\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2021\/oct\/26\/staff-at-tasmanian-youth-detention-centre-allegedly-covered-up-child-sexual-abuse-inquiry-hears\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">both guards and inmates alike were committing sexual assault<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is alleged the centre covered up all instances of sexual abuse.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The mistreatment and abuse of children in detention are unforgivable.
