class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\n<p><a href=\"https:\/\/kelsolawyers.com\/au\/our-work\/institutions\/\">St Ann\u2019s Special School<\/a> (now called Our Lady of La Vang School) was established in 1975 through <a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/catholic-church\/\">Catholic Special Schools Incorporated<\/a>.<\/p>\n\n<p>Based in Adelaide, the school catered for children living with intellectual disabilities ranging from moderate to profound level of severity.<\/p>\n\n<p>St Ann\u2019s taught 50 to 60 children at a time and the age group ranged from five years old to 20 years old. Regardless of age, most of the students had limited communication skills and abilities.<\/p>\n\n<h2>The school\u2019s bus driver, Brian Perkins, used this to his advantage<\/h2>\n\n<p>Perkins had a criminal history. <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\"child abduction by force or fraud, carnal knowledge, attempted carnal knowledge and larceny (opens in a new tab)\">Child abduction by force or fraud, carnal knowledge, attempted carnal knowledge and larceny<\/a>. He had served time in prison before becoming a bus driver for St Ann\u2019s but this didn\u2019t stop him from getting the job.<\/p>\n\n<p>Principal Claude Hamam <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">did not complete a police check<\/a> on Perkins before offering the criminal a job.<\/p>\n<p>This basic check would have revealed Perkin\u2019s history of child sexual abuse.<\/p>\n\n<p>Hamam also <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">failed to interview other applicants and did not consult the St Ann\u2019s chairperson<\/a> before hiring Perkins.<\/p>\n<p>This is against the South Australian Catholic schools handbook.<\/p>\n\n<p>Due to this complete failure in management, <a href=\"https:\/\/www.abc.net.au\/news\/2015-06-04\/royal-commission-releases-findings-into-st-anns-special-school\/6522664\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">Perkins was allowed to abuse more than 30 girls in the 1980s and 1990s<\/a>.<\/p>\n\n<h2>Perkins was required to drive children with intellectual and communication disabilities to and from school each day<\/h2>\n<p>He was unsupervised &#8211; which was not uncommon in the 1980s.<\/p>\n\n<p>It wasn\u2019t until 2002 that the <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">South Australian Commission for Catholic Schools (SACCS) provided funding for an additional staff member on each bus at St Ann\u2019s<\/a>.<\/p>\n\n<p>Perkins also volunteered as a groundskeeper and woodworker at St Ann\u2019s, providing more opportunities for him to abuse the students.<\/p>\n<p>At this time, <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">St Ann\u2019s <\/a><em><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">did <\/a><\/em><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">have a policy which stated volunteers on the grounds needed to be supervised at all times<\/a>\u00a0but Perkins was allowed to work and communicate with students without staff supervision.<\/p>\n\n<p>Perkins also provided \u201crespite care\u201d for some students. In later investigations, <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">Principal Hamam provided evidence the school did not authorise this<\/a>.<\/p>\n\n<h2>In 1991, complaints started flooding in from parents about Perkins<\/h2>\n\n<p>A former student alleged she was taken to Perkin\u2019s hotel and then his flat, where the two consumed alcohol. <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">Perkins asked her to remove her clothes and he took photos of her<\/a>.<\/p>\n\n<p>She was 19 years old at the time.<\/p>\n\n<p>Another victim was identified and the South Australian Police searched Perkin\u2019s home. The officers found <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">two rolls of film and discovered pornographic images of two male students of St Ann\u2019s<\/a>.<\/p>\n\n<p>Following the search, Perkins went missing and the case was filed.<\/p>\n\n<h2>In 1993, South Australian Police received pornographic material picturing an adult male with underage boys<\/h2>\n<p>This triggered them to launch Operation Deny to find Perkins.<\/p>\n\n<p>Perkins was arrested at his son\u2019s house where <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">more pornographic material was found<\/a>. He was charged with forcing a child to expose his body for a prurient purpose, indecent assault and possession of child pornography.<\/p>\n\n<p>On 27 October 1993, Perkins was granted bail in the Magistrates Court. A few months later, more serious sexual offences were laid against Perkins, but <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">he failed to appear for court and an arrest warrant was issued<\/a>.<\/p>\n\n<p>Between January 1994 and February 1998, the police failed to examine the pornographic material involving Perkins and <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">no attempt was made to locate him<\/a>.<\/p>\n\n<p>Perkins was located in Queensland in 1998 but the South Australian Police <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">declined to extradite him due to \u201cinaccurate information\u201d on the seriousness of his charges<\/a>.<\/p>\n<p>The South Australian Police also <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">failed to inform the broader community<\/a> about Perkin\u2019s charges despite the fact that some students still had contact with Perkins.<\/p>\n\n<h2>From 2001, parents and families of St Ann\u2019s students urged the South Australian Police to extradite Perkins<\/h2>\n<p>The Archdiocese of Adelaide even offered to pay for the extradition.<\/p>\n\n<p><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">The police declined<\/a>.<\/p>\n\n<p>It wasn\u2019t until 2003 that Perkins was convicted of five sexual offences against three former students of St Ann\u2019s. He was sentenced to a decade but died in prison in 2009.<\/p>\n\n<p>Through the Towards Healing Program, <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">Catholic Church Insurance paid a total of $800,000 to the St Ann\u2019s victims<\/a>. In 2004, 38 families had come forward for compensation.<\/p>\n\n<p>During the Royal Commission\u2019s investigation of St Ann\u2019s Special School, it was found the response from St Ann\u2019s and the South Australian Police to Perkin\u2019s criminal history and subsequent offending at the school was <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">grossly inadequate<\/a>.<\/p>\n\n<p>The South Australian Police has multiple opportunities to arrest Perkins. He was allowed to escape twice.<\/p>\n\n<p>Principal Hamam also ignored school standards for hiring a volunteer bus driver. He didn\u2019t look into Perkin\u2019s criminal history. A simple check would have flagged Perkins\u2019 prior child sexual abuse offences.<\/p>\n\n<p>Evidence also shows <a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%209%20-%20Findings%20Report%20-%20St%20Anns%20Special%20School.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" aria-label=\" (opens in a new tab)\">Hamam did not question Perkins when the bus was late to school<\/a> &#8211; an almost daily occurrence. He also did not enforce supervision when Perkins was working on the school grounds.<\/p>\n\n<h2>The failure of the school and the police to act in Perkins\u2019 case was horrific<\/h2>\n<p>There were endless opportunities to protect the children from Perkins. No one questioned him. No one looked into his background.<\/p>\n\n<p>This enabled Perkins to abuse children in the woodshed on the grounds. He took explicit photographs of children there.<\/p>\n\n<p>He was allowed to provide \u201crespite care\u201d outside of school hours.<\/p>\n\n<p>At Kelso Lawyers, we believe this is a disgrace.
