{"id":2850,"date":"2018-12-07T14:20:43","date_gmt":"2018-12-07T03:20:43","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/?post_type=newsitem&#038;p=2850"},"modified":"2024-05-30T16:22:15","modified_gmt":"2024-05-30T06:22:15","slug":"tough-new-laws-effect-adelaide-teacher-abuses-child-indigenous-australian-abuse-survivor-dumped","status":"publish","type":"post","link":"https:\/\/kelsolawyers.com\/au\/tough-new-laws-bring-offenders-to-justice\/","title":{"rendered":"Tough New Laws In Effect, Adelaide Teacher Abuses Child &#038; Indigenous Australian Abuse Survivor Dumped"},"content":{"rendered":"<h2>Tough new laws to bring offenders to justice in NSW now in effect<\/h2>\n<p>As of December 1st 2018, <a href=\"https:\/\/www.newcastleherald.com.au\/story\/5787666\/time-to-get-serious-attorney-general-says-institutions-need-to-join-national-redress-scheme\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">new child sexual abuse legislation has come into effect<\/a>, increasing child protection in New South Wales and bringing offenders to justice faster and more effectively.<\/p>\n<p>The new laws make it easier to <a href=\"https:\/\/www.newcastleherald.com.au\/story\/5787666\/time-to-get-serious-attorney-general-says-institutions-need-to-join-national-redress-scheme\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">prosecute persistent child sexual abuse<\/a> and get better results for survivors. There is also a <a href=\"https:\/\/www.newcastleherald.com.au\/story\/5787666\/time-to-get-serious-attorney-general-says-institutions-need-to-join-national-redress-scheme\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">new grooming offence<\/a> to stop abuse in its early stages.<\/p>\n<p>NSW Attorney-General Mark Speakman claims churches and institutions need to join the <a href=\"https:\/\/kelsolawyers.com\/au\/our-work\/national-redress-scheme\/\">National Redress Scheme<\/a> \u201c<a href=\"https:\/\/www.newcastleherald.com.au\/story\/5787666\/time-to-get-serious-attorney-general-says-institutions-need-to-join-national-redress-scheme\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">without further delay<\/a>\u201d now the laws are in place. Some institutions like the <a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/catholic-church\/\">Catholic Church<\/a> still haven\u2019t officially joined &#8211; limiting survivors from achieving justice and claiming compensation.<\/p>\n<p>The latest failure of the scheme follows a woman from Newcastle, Mary, 96, who is likely the <a href=\"https:\/\/www.newcastleherald.com.au\/story\/5527238\/a-settling-of-accounts-for-hunter-abuse-survivor-96\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">oldest Australian to seek compensation under the scheme<\/a>. Mary and her sister were left at The Sisters of <a href=\"https:\/\/kelsolawyers.com\/au\/st-josephs-home\/\">St Joseph Orphanage<\/a> in 1927. The children experienced years of abuse at the hands of the nuns.<\/p>\n<p>\u201c<a href=\"https:\/\/www.newcastleherald.com.au\/story\/5527238\/a-settling-of-accounts-for-hunter-abuse-survivor-96\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">I don\u2019t think they\u2019ve heard of the word Christianity,<\/a>\u201d Mary told the Senate in Newcastle.<\/p>\n<p>Mary\u2019s application has been put on hold as the Catholic Church has failed to join the scheme.<\/p>\n<h2>Adelaide teacher abused student\u2019s kind nature to have sex in a car park<\/h2>\n<p>A teacher in Adelaide has pleaded guilty to repeated sexual exploitation of a child in what has been described as \u201c<a href=\"https:\/\/www.abc.net.au\/news\/2018-11-21\/sonia-ruth-mackay-abused-students-caring-nature-for-sex\/10518658\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">a gross breach of trust<\/a>\u201d.<\/p>\n<p>Sonia Ruth Mackay, 42, was teaching at a prestigious school when she asked for a <a href=\"https:\/\/www.abc.net.au\/news\/2018-11-21\/sonia-ruth-mackay-abused-students-caring-nature-for-sex\/10518658\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">17-year-old student\u2019s phone number<\/a> under the guise she would help him with homework.<\/p>\n<p>Mackay proceeded to send the teenager explicit text messages, started a sexual relationship behind her husband\u2019s back and <a href=\"https:\/\/www.abc.net.au\/news\/2018-11-21\/sonia-ruth-mackay-abused-students-caring-nature-for-sex\/10518658\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">manipulated the child into having sex with her in a public car park.<\/a><\/p>\n<p>Mackay also <a href=\"https:\/\/www.abc.net.au\/news\/2018-11-21\/sonia-ruth-mackay-abused-students-caring-nature-for-sex\/10518658\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">provided the boy with drugs and alcohol<\/a>, bought him expensive gifts to keep him coming back to her, and encouraged him to skip school to be with her. The offending stopped once the abuse was reported to the school\u2019s principal.<\/p>\n<p>\u201c<a href=\"https:\/\/www.abc.net.au\/news\/2018-11-21\/sonia-ruth-mackay-abused-students-caring-nature-for-sex\/10518658\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">You manipulated my son&#8217;s emotions, you carelessly destroyed him<\/a>,\u201d the boy\u2019s mother said in court.<\/p>\n<p>\u201cYou hid the relationship from the school, yet all along took calculated thrill risks to meet your own selfish needs.\u201d<\/p>\n<p>The victim revealed in a statement that he felt <a href=\"https:\/\/www.abc.net.au\/news\/2018-11-21\/sonia-ruth-mackay-abused-students-caring-nature-for-sex\/10518658\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">ashamed and embarrassed<\/a> about what happened.<\/p>\n<h2>Indigenous sexual abuse survivor falls through the cracks as the government plays hard-ball<\/h2>\n<p>Kenneth Stagg, an Indigenous survivor of sexual abuse, has <a href=\"https:\/\/www.abc.net.au\/news\/2018-12-02\/child-sex-abuse-royal-commission-retta-dixon-redress-survivors\/10573132\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">had his case for compensation dropped.<\/a><\/p>\n<p>Kenneth could not bring himself to sign the paperwork that would have allowed lawyers to access his medical files and believed that if he cooperated with the legal process, <a href=\"https:\/\/www.abc.net.au\/news\/2018-12-02\/child-sex-abuse-royal-commission-retta-dixon-redress-survivors\/10573132\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">he would have to agree that the settlement of Indigenous Australia<\/a> and the government-sanctioned child removal policies of the past were legitimate.<\/p>\n<p>His lawyer was forced to drop the case and now Kenneth is facing homelessness due to the trauma he has experienced.<\/p>\n<p>In 2011, Kenneth <a href=\"https:\/\/www.abc.net.au\/news\/2014-09-21\/children-of-stolen-generation-to-recall-abuse-at-inquiry\/5758878\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">told the Royal Commission<\/a> that he and his sisters were taken from their mother at the age of eleven. The children were taken to <a href=\"https:\/\/www.abc.net.au\/news\/2018-12-02\/child-sex-abuse-royal-commission-retta-dixon-redress-survivors\/10573132\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Darwin&#8217;s Retta Dixon home for children of the Stolen Generation<\/a>. The home was part of the Australian Indigenous Ministries, regulated by the Australian Federal Government.<\/p>\n<p>Kenneth and the other children <a href=\"https:\/\/www.abc.net.au\/news\/2014-09-21\/children-of-stolen-generation-to-recall-abuse-at-inquiry\/5758878\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">received frequent \u201cthrashings\u201d and severe sexual abuse<\/a>. Another child in the home <a href=\"https:\/\/www.abc.net.au\/news\/2014-09-21\/children-of-stolen-generation-to-recall-abuse-at-inquiry\/5758878\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">raped Kenneth\u2019s sister<\/a> &#8211; a common occurrence as many children in the home were traumatised.<\/p>\n<p>He <a href=\"https:\/\/www.abc.net.au\/news\/2018-12-02\/child-sex-abuse-royal-commission-retta-dixon-redress-survivors\/10573132\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">recognises he has allowed himself to slip through the cracks<\/a>, partly due to his own choices. Kenneth\u2019s anger towards the government and the inadequacy of the National Redress Scheme have stopped him from pursuing compensation further.<\/p>\n<p>\u201c<a href=\"https:\/\/www.abc.net.au\/news\/2018-12-02\/child-sex-abuse-royal-commission-retta-dixon-redress-survivors\/10573132\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">My family says that I shouldn&#8217;t bite the hand that will feed me,<\/a> but I can&#8217;t.
