{"id":2856,"date":"2019-01-09T14:33:54","date_gmt":"2019-01-09T03:33:54","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/?post_type=newsitem&#038;p=2856"},"modified":"2024-05-30T16:16:57","modified_gmt":"2024-05-30T06:16:57","slug":"archbishop-wilson-appeals-conviction-and-wins","status":"publish","type":"post","link":"https:\/\/kelsolawyers.com\/au\/archbishop-wilson-appeals-conviction-and-wins\/","title":{"rendered":"Former Archbishop Philip Wilson successfully appeals his conviction"},"content":{"rendered":"<p>Former Archbishop of Adelaide Philip Wilson has <a href=\"https:\/\/www.newcastleherald.com.au\/story\/5797832\/former-archbishop-philip-wilsons-conviction-quashed-in-newcastle-court\/?cs=12&amp;fbclid=IwAR24y-TT7OED85LBlxNPtkpzlVnAVQpr0M17A9qbj_-Cj7RQPsIvtOhfhIo\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">appealed his conviction of concealing child sexual abuse.<\/a><\/p>\n<p>The Newcastle Local Court found the archbishop was told about child abuse in the church and the sexual misconduct of now-notorious paedophile priest, <a href=\"https:\/\/kelsolawyers.com\/au\/jim-fletcher\/\" target=\"_blank\" rel=\"noopener noreferrer\">Jim Fletcher<\/a>, as early as 1976.<\/p>\n<p>The Magistrate said Wilson had failed to contact police regarding the allegations and has maintained his innocence, claiming he has <a href=\"https:\/\/www.newcastleherald.com.au\/story\/5797832\/former-archbishop-philip-wilsons-conviction-quashed-in-newcastle-court\/?cs=12&amp;fbclid=IwAR24y-TT7OED85LBlxNPtkpzlVnAVQpr0M17A9qbj_-Cj7RQPsIvtOhfhIo\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">no recollection of the child abuse complaints<\/a>. Fletcher abused a minimum of nine children in the Hunter and was not charged until 2005.<\/p>\n<p>Wilson was sentenced to 12 months in jail including six months home detention on the Central Coast.<\/p>\n<p>But in 2018, the District Court was asked to consider whether prosecutors had proven beyond a reasonable doubt that Wilson had failed to report the allegations about Fletcher.<\/p>\n<p>The judge ruled in Wilson\u2019s favour and the conviction was quashed. Wilson is now a free man.<\/p>\n<h2>Ellis Defence abolished in \u201cmomentous day\u201d for victims of institutional abuse<\/h2>\n<p>The Ellis Defence has been scrapped in New South Wales. The legal roadblock has stopped hundreds of institutional abuse victims from suing unincorporated organisations like the <a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/catholic-church\/\" target=\"_blank\" rel=\"noopener noreferrer\">Catholic Church<\/a>.<\/p>\n<p>From January 2019, offending institutions will have to <a href=\"https:\/\/www.abc.net.au\/news\/2019-01-01\/catholic-church-ellis-defence-scrapped-from-new-years-day\/10675890\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">nominate a defendant with sufficient assets to fund survivor compensation claims<\/a>. If no defendant is found, the court can appoint associated trustees who can get access to trusts.<\/p>\n<p>The move comes from recommendations handed down by the Royal Commission into Institutional Responses to Child Sexual Abuse.<\/p>\n<p>The Ellis Defence was created when John Ellis, a former altar-boy, tried to sue the Catholic Church in 2007. John\u2019s abuser had died and there was no one left to sue, but the court found the <a href=\"https:\/\/www.abc.net.au\/news\/2019-01-01\/catholic-church-ellis-defence-scrapped-from-new-years-day\/10675890\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">church did not legally exist<\/a> because the assets were hidden away in a trust and could not be sued for the crimes of the priest.<\/p>\n<p>John is now celebrating the news.<\/p>\n<p>\u201c<a href=\"https:\/\/www.abc.net.au\/news\/2019-01-01\/catholic-church-ellis-defence-scrapped-from-new-years-day\/10675890\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">It&#8217;s fantastic news,<\/a>\u201d John told the ABC.<\/p>\n<p>\u201cIt really is a momentous day to have those changes finally commence.\u201d<\/p>\n<h2>US Catholic Church names 1,000 priests accused of child sexual abuse<\/h2>\n<p>Roman Catholic bishops across the United States have released the names of <a href=\"https:\/\/www.abc.net.au\/news\/2019-01-04\/us-catholic-church-names-over-1000-priests-in-sex-abuse-cases\/10683870\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">more than 1,000 priests<\/a> accused of child sexual abuse. The release has been called an \u201c<a href=\"https:\/\/www.abc.net.au\/news\/2019-01-04\/us-catholic-church-names-over-1000-priests-in-sex-abuse-cases\/10683870\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">unprecedented public reckoning<\/a>\u201d.<\/p>\n<p>At least <a href=\"https:\/\/www.abc.net.au\/news\/2019-01-04\/us-catholic-church-names-over-1000-priests-in-sex-abuse-cases\/10683870\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">50 diocese and religious organisations have stepped forward<\/a> with names. Another 55 are planning to do the same in coming months. Altogether, these dioceses make up more than half of the religious organisations in the United States.<\/p>\n<p>The big reveal comes in the wake of the Pennsylvania Report. During the investigation, officials found more than <a href=\"https:\/\/www.abc.net.au\/news\/2018-08-15\/report-identifies-1000-victims-of-priest-abuse-in-pennsylvania\/10122056\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">300 paedophile priests dating back seven decades<\/a>. More than <a href=\"https:\/\/www.abc.net.au\/news\/2018-08-15\/report-identifies-1000-victims-of-priest-abuse-in-pennsylvania\/10122056\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">1,000 children were abused<\/a> and senior church officials covered up the abuse for almost a century.<\/p>\n<p>The abuse ranged from groping and masturbation to penetrative rape. It was reported priests called it \u201c<a href=\"https:\/\/www.abc.net.au\/news\/2018-08-15\/report-identifies-1000-victims-of-priest-abuse-in-pennsylvania\/10122056\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">horseplay\u201d or \u201cwrestling<\/a>\u201d.<\/p>\n<h2><b>Get the justice you deserve with Kelso Lawyers.
