{"id":5989,"date":"2019-09-10T13:10:09","date_gmt":"2019-09-10T03:10:09","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/new-kelsos\/?p=5989"},"modified":"2024-05-30T16:11:52","modified_gmt":"2024-05-30T06:11:52","slug":"archbishop-prefers-prison-over-breaking-confessional-seal","status":"publish","type":"post","link":"https:\/\/kelsolawyers.com\/au\/archbishop-prefers-prison-over-breaking-confessional-seal\/","title":{"rendered":"Archbishop prefers prison over breaking confessional seal"},"content":{"rendered":"<h3><b>Melbourne Archbishop says prison time preferable to breaking the seal of confession\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Melbourne Archbishop Peter Comensoli has claimed <\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2019\/aug\/14\/victorian-bill-would-compel-priests-to-report-child-abuse-confessions-or-risk-jail\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">three years imprisonment would be preferable to a priest breaking the seal of confession and reporting child sexual abuse to police<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">New laws were introduced in August which make religious ministers mandatory reporters of abuse suspicions alongside police, teachers, medical practitioners and early childhood workers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Priests could face jail time for concealing child sexual abuse revealed in confession.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Archbishop Comensoli spoke to ABC Radio in Victoria mid-August regarding the new laws.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2019\/aug\/14\/victorian-bill-would-compel-priests-to-report-child-abuse-confessions-or-risk-jail\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">I hold the principle of mandatory reporting\u2026 and I also hold onto the principle of the seal of confession<\/span><\/a><span style=\"font-weight: 400;\">,\u201d Archbishop Comensoli said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cMy own position is that I don\u2019t see that as mutually exclusive.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Archbishop said he would ask a child abuser to discuss the crimes outside the confessional box. However, if the abuser refused, <\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2019\/aug\/14\/victorian-bill-would-compel-priests-to-report-child-abuse-confessions-or-risk-jail\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">he would \u201ckeep the seal\u201d<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.theguardian.com\/world\/2018\/jun\/15\/south-australia-catholic-church-to-ignore-law-on-reporting-confessions-of-abuse\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">Catholic Archbishops in the Australian Capital Territory and South Australia have also vowed to reject the laws<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Victoria\u2019s Liberal-National opposition has indicated it would back a law mandating priests report child abuse allegations. Crossbench MP Fiona Patten welcomed the government\u2019s move.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2019\/aug\/14\/victorian-bill-would-compel-priests-to-report-child-abuse-confessions-or-risk-jail\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">I think that Jesus would mandatory report<\/span><\/a><span style=\"font-weight: 400;\">,\u201d Fiona said.<\/span><\/p>\n<h3><b>23-year-old Sydney man faces 65 child sexual abuse charges over \u201csextortion\u201d of teen<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">A 23-year-old man from the Northern Beaches will be charged with <\/span><a href=\"https:\/\/www.smh.com.au\/national\/nsw\/man-charged-with-sextortion-of-teen-to-face-new-charges-over-35-children-20190903-p52nnx.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">65 offences relating to the alleged sexual exploitation of another 35 child victims<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kurtis Whaley was arrested earlier this year after<\/span><a href=\"https:\/\/www.smh.com.au\/national\/nsw\/man-charged-with-sextortion-of-teen-to-face-new-charges-over-35-children-20190903-p52nnx.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\"> he lied about his age and identity online<\/span><\/a><span style=\"font-weight: 400;\"> to elicit sexually explicit photos from a 16-year-old teenager.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When the girl refused to send more photos, Whaley <\/span><a href=\"https:\/\/www.smh.com.au\/national\/nsw\/man-charged-with-sextortion-of-teen-to-face-new-charges-over-35-children-20190903-p52nnx.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">threatened to share the photos with her friends and family members<\/span><\/a><span style=\"font-weight: 400;\">. This prompted the teenager to tell her family and report Whaley to the police.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The 65 charges include both soliciting and transmitting child pornography.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He is due to face court on Wednesday 4th September 2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whaley has already been charged with <\/span><a href=\"https:\/\/www.smh.com.au\/national\/nsw\/man-charged-with-sextortion-of-teen-to-face-new-charges-over-35-children-20190903-p52nnx.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">using a carriage service to groom a person under 16-years-old for sexual activity, soliciting child pornography and using a carriage service to transmit child pornography, threaten serious harm and procure sexual activity with a person under 16-years-old.<\/span><\/a><\/p>\n<h3><b>Family Court reporter charged for sexually abusing three children<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">A psychologist appointed by the Family Court to assist in custody disputes involving allegations of child sexual abuse has been <\/span><a href=\"https:\/\/www.abc.net.au\/news\/2019-08-26\/family-court-report-writer-charged-with-child-sex-abuse\/11434172\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">charged with sexually abusing three children<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The alleged paedophile was<\/span><a href=\"https:\/\/www.abc.net.au\/news\/2019-08-26\/family-court-report-writer-charged-with-child-sex-abuse\/11434172\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\"> tasked with making recommendations in cases where one parent has accused the other of sexual abuse<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The child abuse allegations could overturn court rulings which involved the psychologist\u2019s recommendations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One mother was sent to the psychologist in 2013 after she accused her husband of abusing their three-year-old daughter. She said <\/span><a href=\"https:\/\/www.abc.net.au\/news\/2019-08-26\/family-court-report-writer-charged-with-child-sex-abuse\/11434172\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">the psychologist made her feel uncomfortable and implied her husband abused their daughter because she was not meeting his sexual needs<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHe was kind of overly physical with me. He kept touching my arm and my leg. It made me feel creeped out,\u201d the mother said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHe said weird things. He kept telling me that he knew about real paedophiles and that they would show up on [psychometric] tests.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.abc.net.au\/news\/2019-08-26\/family-court-report-writer-charged-with-child-sex-abuse\/11434172\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">He was absolutely adamant that he would be able to tell a real paedophile.
