{"id":6846,"date":"2019-12-19T08:36:45","date_gmt":"2019-12-18T21:36:45","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/?p=6846"},"modified":"2023-09-04T11:21:08","modified_gmt":"2023-09-04T01:21:08","slug":"north-coast-childrens-home-lismore","status":"publish","type":"post","link":"https:\/\/kelsolawyers.com\/au\/north-coast-childrens-home-lismore\/","title":{"rendered":"Offending Institution: North Coast Children\u2019s Home (Lismore NSW)"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The North Coast Children\u2019s Home in Lismore is one of <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/our-work\/clergy-and-institutional-abuse-claims\/abuse-law-involving-institutions\/new-south-wales-nine-worst-childrens-homes\/\"><span style=\"font-weight: 400;\">the worst offending institutions in New South Wales<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the Royal Commission, <\/span><a href=\"https:\/\/www.abc.net.au\/pm\/content\/2013\/s3893596.htm\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">several child abuse survivors testified, sharing horrific stories of physical, psychological and sexual abuse at the hands of the Anglican Church<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2>History and conditions of the home<\/h2>\n<p><span style=\"font-weight: 400;\">The North Coast Children&#8217;s Home was established in 1919 through St Andrews\u2019 Anglican Church and the Church of England. The home was designed to house children who were orphans, wards of the state, or had been abandoned by their parents.<\/span><\/p>\n<p>The orphanage was strongly associated with the Anglican Church and under the home&#8217;s constitution, at least two-thirds of the board of management had to be members of the Church of England.<\/p>\n<p>Despite this close association, the home was very poorly funded in the 1950s and 1960s. <span style=\"font-weight: 400;\">A survivor known as CN said there was <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">limited clothing for the children and the home was unsanitary<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In one of the Royal Commission&#8217;s hearings, CN recalled arriving for the first time and being mortified.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">It smelt terrible, like faeces, and there was vomit on the ground. I could see about <\/span><\/a><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">twenty-odd children, all dirty<\/span><\/a><span style=\"font-weight: 400;\">,\u201d CN said.<\/span><\/p>\n<h2>&#8220;There was no maternal instinct at all&#8230; all you heard in that place was kids bawling and screaming&#8221;<\/h2>\n<p><span style=\"font-weight: 400;\">According to survivors who testified at the Royal Commission, beatings were regular and incredibly brutal. Survivors said they were beaten with a wide range of weapons including:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A pony whip or riding crop made of steel and covered in leather<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A strap or an electrical cord<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A cane or tree branch<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A leather belt and buckle from a member of the clergy&#8217;s cassock<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If the children wet their beds, <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">their soiled sheets would be wrapped around their heads and they would be paraded around in front of the other children<\/span><\/a><span style=\"font-weight: 400;\"> as a form of public humiliation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, the children would be <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">forced to stand in uncomfortable positions for hours on end<\/span><\/a><span style=\"font-weight: 400;\">. For example, a survivor known as CB was forced to stand with his arms outstretched, naked, with a Bible in each hand. The other children had to watch him and he was beaten if he moved.<\/span><\/p>\n<p>A survivor known only as GG has been fighting the Anglican Church over the physical abuse he experienced at the North Coast Children&#8217;s Home since 2008. He told reporters <a href=\"https:\/\/www.dailytelegraph.com.au\/news\/nsw\/lismore\/everyone-was-abused-says-nc-childrens-home-survivor\/news-story\/5e04ca2690f4563ec721ed6dd1ef1a4e\" target=\"_blank\" rel=\"noopener nofollow\">&#8220;everyone was abused&#8221; at the home<\/a> and by the time he left, he was suicidal and struggled to function in everyday society.<\/p>\n<blockquote>\n<p style=\"text-align: left;\"><em>&#8220;I&#8217;m not playing down the sexual assaults, but everyone was abused and it&#8217;s not how you got to the result, it&#8217;s what the end result was,&#8221; GG said.<\/em><\/p>\n<p style=\"text-align: left;\"><em>&#8220;Kids were bloody terrified&#8230; there was no maternal instinct at all. All you heard in that place was kids bawling and screaming.&#8221;\u00a0<\/em><\/p>\n<p style=\"text-align: left;\"><em>&#8220;They used to walk around with this horsewhip. They would sneak around and the next minute they&#8217;re coming up behind you&#8230; and for the slightest misdemeanour, they would beat you.&#8221;<\/em><\/p>\n<\/blockquote>\n<p>After his stay at the North Coast Children&#8217;s Home, GG applied for an army apprenticeship but was rejected because <a href=\"https:\/\/www.dailytelegraph.com.au\/news\/nsw\/lismore\/everyone-was-abused-says-nc-childrens-home-survivor\/news-story\/5e04ca2690f4563ec721ed6dd1ef1a4e\" target=\"_blank\" rel=\"noopener nofollow\">the army psychiatrist didn&#8217;t have the &#8220;time or money&#8221; to treat his mental illness<\/a>.<\/p>\n<blockquote><p><em>&#8220;That was the best opportunity I could have had in my life&#8230; but because of how I was treated in the home I was kicked out and that&#8217;s why I reckon they (the Church) owe me (compensation).&#8221;<\/em><\/p>\n<p><em>&#8220;There are so many mental illness things that go on because of what went on there.&#8221;<\/em><\/p><\/blockquote>\n<h2>Sexual abuse was rife at the North Coast Children&#8217;s Home<\/h2>\n<p><span style=\"font-weight: 400;\">Sexual abuse was horrifically common at the orphanage. The crimes were committed by members of the clergy, staff members, other residents and their relatives. <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">These instances included oral sex, sexual intercourse and gang rape among the children<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Royal Commission heard the emotional, physical and psychological abuse caused <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">lifelong problems with anxiety, depression, drug and alcohol abuse, sleeping problems and the inability to maintain meaningful relationships<\/span><\/a><span style=\"font-weight: 400;\">. Many have also considered committing suicide.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2006 more than 40 former residents of the North Coast Children\u2019s Home in Lismore banded together and submitted a group claim against the Anglican Diocese of Grafton.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What the claimants didn\u2019t expect was an extra slap in the face &#8211; the Anglicans <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">denied running the home and claimed they had no legal liability for sexual or physical abuse committed at the orphanage<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Church took a <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">hostile defensive legal position against the group claim<\/span><\/a><span style=\"font-weight: 400;\">. The Church\u2019s lawyers required claimants to sign a deed of release before they could receive counselling, acknowledgement, apology or financial settlement &#8211; going against the Sydney Pastoral Care and Assistance Scheme that the Diocese <\/span><span style=\"font-weight: 400;\">of Grafton had adopted one year prior.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The claimants were also <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">not referred to a Professional Standards Director<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After several arguments and counter-offers regarding financial reparations, <\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">the highest offer given was $22,658.54<\/span><\/a><span style=\"font-weight: 400;\">. However, after Medicare and Health Insurance Commissions, the claimants could have received less than half that amount.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the following years, more survivors of child abuse at the home came forward to receive compensation. Two survivors known as CB and CC were refused financial compensation and offered a support person. A third survivor known as CD received a payment but no pastoral support.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It wasn\u2019t until 2013 that the Anglican Church revised its handling of child abuse claims. The new acting registrar in Grafton reported the mishandling to the Anglican Church Primate &#8211; the official leader of the Anglican Church in Australia.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In May 2013, the Bishop of Grafton released a statement apologising for not giving claimants access to a Professional Standards Director and resigned. A series of apologies were also published in local newspapers and the Diocese passed a revised Care and Assistance Scheme for claimants.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cases that had not been investigated were also re-opened.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Diocese of Grafton backflipped on their original statement and <\/span><a href=\"https:\/\/www.abc.net.au\/pm\/content\/2013\/s3893596.htm\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">said there was no doubt about their responsibility for the residents of the North Coast Children&#8217;s Home<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Between November 2013 and January 2014, the Royal Commission heard from various former residents of the home including the group claim\u2019s lead plaintiff, Mr Tommy Campion and various anonymous survivors like CA, CB, CD, CH, CK, CN and two others.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">CK told the Commissioners about the trauma inflicted from living at the group home.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.childabuseroyalcommission.gov.au\/sites\/default\/files\/file-list\/Case%20Study%203%20-%20Findings%20Report%20-%20North%20Coast%20Childrens%20Home.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span style=\"font-weight: 400;\">The pain that we have, we will take to the grave. The ones who have suicided, they\u2019re possibly the lucky ones. We\u2019re the living dead that remain<\/span><\/a><span style=\"font-weight: 400;\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No child should ever be subjected to the kind of pain and torture these individuals experienced. Their childhood was a living hell and there was no one to help them &#8211; no friends, no family, no trustworthy carer.
