{"id":8654,"date":"2020-07-17T14:39:20","date_gmt":"2020-07-17T04:39:20","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/?p=8654"},"modified":"2024-05-30T16:18:39","modified_gmt":"2024-05-30T06:18:39","slug":"kelso-lawyers-law-reforms","status":"publish","type":"post","link":"https:\/\/kelsolawyers.com\/au\/kelso-lawyers-law-reforms\/","title":{"rendered":"How Kelso Lawyers has forced governments to change laws for victims for the better"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">When you choose Kelso Lawyers, you\u2019re not just choosing a team of experienced solicitors. We believe all institutional and child abuse should be given a fair shot at compensation &#8211; no matter the context and no matter whether the abuse was sexual, physical, or psychological.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We\u2019ve taken entire government departments to court, lobbied politicians, conducted numerous radio interviews, spoken up at commissions of inquiry, written lengthy submissions to cabinet Ministers, exposed injustice on the internet and social media and worked in the background on several high rating television programs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Peter Kelso has been the point man every time. He\u2019s put his reputation on the line time and time again. He\u2019s even risked his own family finances. Very few people will do that &#8211; but it\u2019s all been for a greater purpose.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">All survivors deserve justice.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this article, we share a few examples of how we\u2019ve influenced important law reforms and changed government practices to bring real justice to survivors. Read on.<\/span><\/p>\n<h2><b>#1. Kelso Lawyers successfully prosecuted the Commissioner of Victims\u2019 Rights in Dobbie v CVR in the NSW Court of Appeal\u00a0<\/b><\/h2>\n<p>Mr Dobbie and his brother were severely beaten by their father when they were children. However, the Assessor awarded payment to Mr Dobbie\u2019s brother for the highest category of psychological disablement but refused to do the same for Mr Dobbie \u2013 despite clear evidence from the Commissioner\u2019s own appointed expert that Mr Dobbie easily qualified for this category of award, too.<\/p>\n<p><span style=\"font-weight: 400;\">Mr Dobbie couldn\u2019t afford to fight the decision, so Kelso Lawyers funded the court action against the Commissioner. Both the Court of Appeal and the NSW Supreme Court held that Assessors at Victims Services are not free to refuse to follow sound expert medical evidence without good reason.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Until the Dobbie decision, Assessors had been in the habit of ignoring expert evidence which would require them to award more compensation. In this case, the pressure to stick to set budgets trumped the Assessor\u2019s duty to apply the law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Dobbie case also confirmed the Court can order the Commissioner (and other officials) to correct an invalid compensation decision within a set period of time, or else be in contempt.\u00a0<\/span><\/p>\n<p>The Commissioner argued in the Dobbie case that the Court did not have the power to set a deadline for it to comply with an order. The Court not only disagreed but a Supreme Court Judge ordered the Commissioner to pay Mr Dobbie\u2019s legal costs.<\/p>\n<p><span style=\"font-weight: 400;\">Mr Dobbie received the compensation he was entitled to and Kelso Lawyer\u2019s legal costs were rightly paid for by the Commissioner.\u00a0<\/span><\/p>\n<h2><b>#2. Kelso Lawyers made successful submissions to the NSW Attorney General to amend section 43A Crimes Act to include child-neglect cases\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The 43A Crimes Act refers to the failure of a person with parental responsibilities to care for a child. This can cause a danger of health, injuries, and possible death due to parental neglect.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many years ago when the offence of \u201ccriminal neglect\u201d was amended in the Crimes Act, Parliament failed to update related legislation. This had unintended side-effects &#8211; Assessors at Victims Services (VS) were allowed to decide to neglect an adult was compensatable but neglecting the necessities of life of a child was not!<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the time, Peter Kelso was an external auditor for the NSW Department of Family &amp; Community Services. Peter has been auditing the files of State wards since 2011. He made successful submissions to the NSW Attorney General to amend this section of the Crimes Act.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This change opened up important opportunities for children abused in State care to claim victims compensation (now known as \u2018recognition payments\u2019) from the State government. This has resulted in additional awards being made for State wards which are held in trust for them until they turn 18-years-old.<\/span><\/p>\n<h2><b>#3. Kelso Lawyers were at the forefront of efforts to pressure the NSW and Queensland Attorneys General to abolish limitation periods for historic child abuse victims<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The three-year limitation period was first abolished in Victoria. Kelso\u2019s wrote to other State Attorneys General with submissions and pressured them to do the same as Victoria.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Peter appeared in <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/media\/\"><span style=\"font-weight: 400;\">several media interviews<\/span><\/a><span style=\"font-weight: 400;\"> when the NSW Attorney General announced the popular decision to change the law and allow retrospective civil actions against institutions responsible for the criminal actions of their clergy and other staff. This important change to the law gave victims the option to sue institutions in court for compensation.<\/span><\/p>\n<h2><b>#4. Kelso Lawyers self-funded a number of NSW Civil &amp; Administrative Tribunal (NCAT) cases for victims of crime<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">These included:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Enforcing the rights of rescuers to receive cash \u2018recognition payments\u2019 from Victims Services. In Callaghan v The Commissioner of Victims\u2019 Rights, despite being first responder on the scene of a shooting and assisting the wounded victims while the gunman was still present, the Commissioner asserted that the responder was not entitled to a recognition payment. Kelso Lawyers took the responder\u2019s case to the NSW Civil and Administrative Tribunal (NCAT) and won.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Establishing that \u2018Grievous Bodily Harm\u2019 under the Victims Support and Rehabilitation Act can be satisfied by pure psychological harm, not just physical harm. The Commissioner of Victims\u2019 Rights rejected the argument, but Kelso Lawyers took the claim to NCAT and won.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Establishing that the Commissioner of Victims\u2019 Rights can be ordered to pay legal costs in challenges before NCAT. The Commissioner previously asserted that NCAT didn\u2019t have the power to make a costs order, which dissuaded many victims from appealing Assessors\u2019 decisions.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><b>#5. Kelso Lawyers are prosecuting and self-funding the Supreme Court Case of Cantwell v State of NSW<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">This case aims to make the Government legally responsible to compensate State wards abused by a foster parent. The case seeks to bring the law in Australian states into line with <\/span><span style=\"font-weight: 400;\">the laws in New Zealand<\/span><span style=\"font-weight: 400;\">, Canada, and the United Kingdom.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It follows the decision of the Supreme Court of the United Kingdom in 2017 in Armes v Nottinghamshire.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At present, the Government in Australia has no legal liability for the criminal actions of foster parents against wards. In New South Wales, wards who were sexually abused by a foster parent can apply for a maximum $10,000 payment from Victims Services.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This inequity has to change.<\/span><\/p>\n<h2><b>#6. Kelso Lawyers acted for 162 ex \u2018Parramatta Girls\u2019 against the NSW Department of Family and Community Services for abuse by officers at Parramatta Girls Training School (PGTS)<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Peter Kelso acted for four Parramatta girls at the Child Abuse Royal Commission in 2014. He subsequently risked his family home and self-funded 162 separate compensation claims against the NSW Department of Family and Community Services.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the same time, he funded the development of equity-based forced work claims before the Limitation Act was amended. He did this to try and get additional compensation for girls who were used as free child labour (slave labour) in the Department\u2019s commercial laundry at <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/parramatta-girls-training-school\/\"><span style=\"font-weight: 400;\">Parramatta Girls Training School<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kelso Lawyers have acted for 75% of all Parramatta Girls Training School claims brought against the State of NSW.<\/span><\/p>\n<h2><b>#7. Kelso Lawyers provided all the witnesses for the successful police prosecution of former child welfare bosses, Frank Valentine and Noel Greenaway<\/b><\/h2>\n<p><a href=\"https:\/\/kelsolawyers.com\/au\/paedophile-offenders\/paedophile-offenders-frank-valentine\/\"><span style=\"font-weight: 400;\">Frank Valentine<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/paedophile-offenders\/noel-greenaway\/\"><span style=\"font-weight: 400;\">Noel Greenaway<\/span><\/a><span style=\"font-weight: 400;\"> are both serving prison sentences of over 20 years each. These perpetrators sexually abused and physically assaulted dozens of teenage girls placed under their care in the 1960s and \u201970s at Parramatta Girls\u2019 Training School.<\/span><\/p>\n<h2><b>#8. Kelso Lawyers\u2019 clients appeared on the two 60 Minutes TV episodes for Parramatta Girls Training School and Daruk Boys Home<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">These high-rating stories publicised the plight of many men and women who were sexually abused at these State run homes for boys and girls.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This led to hundreds of successful civil claims and several police prosecutions and perpetrators.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the moment, the former superintendent of <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/daruk-boys-home\/\"><span style=\"font-weight: 400;\">Daruk Boys Home<\/span><\/a><span style=\"font-weight: 400;\"> and former federal MP, Mr Alasdair Webster, is being prosecuted by police.<\/span><\/p>\n<h2><b>#9. Kelso Lawyers made expert legal submissions to the Child Abuse Royal Commission and the Joint Select Committee on the National Redress Scheme<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In late 2018, we made an expert submission to the Joint Select Committee regarding the progress of the <\/span><a href=\"https:\/\/kelsolawyers.com\/au\/our-work\/national-redress-scheme\/\"><span style=\"font-weight: 400;\">National Redress Scheme<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We recommended the following areas be reviewed by the Committee:<\/span><\/p>\n<ul>\n<li><b>Foster care abuse<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">. We recommended the National Redress Scheme amend the rules to make institutions responsible for the abuse by relatives, neighbours, and friends of the foster parent where the institution arranged the foster placement.<\/span><\/span><\/li>\n<li><b>Accountability for the National Redress Scheme. <\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We stated the National Redress Scheme should allow survivors to apply for a review of their offer of compensation if it is considered too low. Legal costs should also be covered so their redress is not lowered to cover the mistakes of a National Redress Scheme Operator.<\/span><\/span><\/li>\n<li><b><b>Correcting unfair and inappropriate elements of the National Redress Scheme. <span style=\"font-weight: 400;\">We recommended the National Redress Scheme increase the maximum payment to $200,000, simplify the application process, allow all survivors of abuse to apply, remove the restrictions on incarcerated victims, remove the rejection deadline, and apply the maximum redress cap on a \u201cset of abuse\u201d basis.<\/span><\/b><\/b><\/li>\n<li><b>Improving accessibility to the National Redress Scheme. <span style=\"font-weight: 400;\">We recommended the National Redress Scheme website be made more accessible and user friendly, make the paperwork and application form easier to understand, advertise the National Redress Scheme in public places, and make use of SMS communication with survivors.<\/span><\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><b>#10. Peter Kelso continues to inform the public every day with news and updates about institutional child sexual abuse via social media\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Kelso Lawyers is committed to keeping the general public informed about injustice in Australia and around the world. With more than 36,000 followers, Peter updates the general public on news about child abuse and shines a light on paedophile offenders who continue to fly under the radar.<\/span><\/p>\n<h2><b>We will continue to fight on behalf of all survivors of institutional abuse\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">We\u2019re proud of what we\u2019ve achieved so far, but we\u2019re not done yet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Not by a long shot.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are still survivors who need our help to fight back against institutions. There are still laws harming survivors of abuse, rather than helping them. For example, the National Redress Scheme\u2019s tendency to exclude State wards who were abused by their foster parents, or exclude survivors who are serving a prison sentence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is unfair.
