{"id":9054,"date":"2021-01-11T16:01:09","date_gmt":"2021-01-11T05:01:09","guid":{"rendered":"https:\/\/kelsolawyers.com\/au\/?p=9054"},"modified":"2026-04-16T16:20:19","modified_gmt":"2026-04-16T06:20:19","slug":"1990s-claimants-can-now-sue-catholic-church","status":"publish","type":"post","link":"https:\/\/kelsolawyers.com\/au\/1990s-claimants-can-now-sue-catholic-church\/","title":{"rendered":"Failed Catholic Church appeal paves the way for hundreds of survivors to sue for top ups"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">In 1996, a former altar boy known as WCB was <\/span><a href=\"https:\/\/www.smh.com.au\/national\/church-s-appeal-loss-paves-way-for-abuse-survivors-to-sue-20201218-p56osy.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">paid $32,500 by the Catholic Church<\/span><\/a><span style=\"font-weight: 400;\"> after he was repeatedly sexually abused by a Warragul priest from 1977 to 1980.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">WCB, like many other survivors of abuse, was paid to remain silent in the 1990s. The <a href=\"https:\/\/kelsolawyers.com\/au\/institutions\/catholic-church\/\">Catholic Church<\/a> wanted to keep their stories hush-hush and maintain their reputation in the public sphere.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It wasn\u2019t easy for WCB to win this meager compensation, either. The Catholic Church <\/span><a href=\"https:\/\/www.smh.com.au\/national\/church-s-appeal-loss-paves-way-for-abuse-survivors-to-sue-20201218-p56osy.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">tried to deny the abuse ever happened<\/span><\/a><span style=\"font-weight: 400;\">, despite the priest admitting to the abuse before he died in 1995.<\/span><\/p>\n<p><a href=\"https:\/\/www.smh.com.au\/national\/church-s-appeal-loss-paves-way-for-abuse-survivors-to-sue-20201218-p56osy.html\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">The priest was also facing criminal charges for multiple instances of child sexual abuse before his death<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">WCB was insulted by the whole experience, especially considering the horrendous abuse he suffered when he was 12-years-old. The abuse had an intense impact on his life. <\/span><a href=\"https:\/\/www.smh.com.au\/national\/church-s-appeal-loss-paves-way-for-abuse-survivors-to-sue-20201218-p56osy.html\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">To make matters worse, the church also failed to apologise to WCB for what happened to him as a child<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the Supreme Court overturned the deed of release in December 2020. This allowed WCB to sue the Catholic Church for more damages and receive the full compensation he deserves.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Catholic Church attempted to appeal the court\u2019s decision, but the challenge was rejected in WCB\u2019s favour.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Appeals judges David Beach, Stephen Kaye and Robert Osborn said the 1996 payment was a <\/span><a href=\"https:\/\/www.smh.com.au\/national\/church-s-appeal-loss-paves-way-for-abuse-survivors-to-sue-20201218-p56osy.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">\u201cvery modest one\u201d and did not commensurate \u201cfor the wrong done to [WCB]\u201d<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Diocese of Sale said it would consider the court\u2019s findings &#8211; but the Catholic Church would have to go to the High Court to lodge another appeal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Court of Appeal\u2019s ruling means WCB can sue the church in 2021. It also means <\/span><a href=\"https:\/\/www.smh.com.au\/national\/church-s-appeal-loss-paves-way-for-abuse-survivors-to-sue-20201218-p56osy.html\" target=\"_blank\" rel=\"noopener nofollow\"><span style=\"font-weight: 400;\">other abuse victims who received capped payments in the 1990s could sue the church<\/span><\/a><span style=\"font-weight: 400;\"> for top-ups. This includes compensation awarded under the Melbourne Response Scheme.<\/span><\/p>\n<h2><b>Hundreds of abuse survivors could be eligible for more compensation\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In 2019, the Victorian Government passed a law allowing the court to set aside a past deed of release relating to child abuse.
